This Personal Information is obtained in many ways including interviews, correspondence by telephone and facsimile, by email, via our website www.kozekoze.com, from your website, from media and publications, from other publicly available sources, from cookies, from Klayvio, and from third parties. We don’t guarantee website links or the policy of authorized third parties. 

We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients, and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record, or health information.

Sensitive information will be used by us only:

  • For a secondary purpose that is directly related to the primary purpose

Third Parties

Contact Forms

To assist with sending you requested information, we use Klayvio to collect and store your email address. Klayvio outlines their use of your personal data and anonymized data here. You may opt out of the collection of your data by unsubscribing (we will remove your data) and contacting them using the instructions on their privacy page.

Disclosure of Personal Information

Your Personal Information may be disclosed in a number of circumstances including the following:

  • Third parties where you consent to the use or disclosure; and

  • Where required or authorized by law.

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification, or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files, which will be kept by us for a minimum of seven years.

You may access the Personal Information we hold about you to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.

kozēkozē will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information we may require identification from you before releasing the requested information.

Maintaining the Quality of your Personal Information

It is important to us that your Personal Information is up-to-date. We will take reasonable steps to make sure that your Personal Information is accurate, complete, and up-to-date. If you find that the information we have is not up-to-date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

Your California Privacy Rights 

If you are a California resident, California Civil Code Section 1798.83 permits you to opt out of the disclosure of your personal data by us to third parties for those third parties’ direct marketing purposes.  To make a request to opt out of such disclosure, please use the Menu section of the App or the FAQ section of a Website. 

The California Consumer Privacy Act (“CCPA”) also provides California residents with rights to receive certain disclosures regarding the collection, use, and sharing of “Personal Information,” as well as rights to access and control Personal Information. The CCPA defines “Personal Information” to mean “information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.” Certain information we collect may be exempt from the CCPA because it is considered public information (i.e., it is made available by a government entity) or covered by a federal privacy law, such as the Gramm-Leach-Bliley Act, the Health Insurance Portability and Accountability Act, or the Fair Credit Reporting Act.

Right to Access Information 

You have the right to request access to Personal Information collected about you and information regarding the source of that information, the purposes for which we collect it, and the third parties and service providers with whom we share it. To protect our customers’ Personal Information, we will verify your identity before we can act on your request by seeking information which may include: (i) device ID; (ii) your player identification name and/or number; (iii) name; (iv) confirmation of California residency; (v) physical address and/or (vi) email.

Right to Request Deletion of Information 

You have the right to request, in certain circumstances, that we delete any Personal Information that we have collected directly from you. To protect our customers’ Personal Information, we will verify your identity before we can act on your request by seeking information which may include: (i) device ID; (ii) your player identification name and/or number; (iii) name; (iv) confirmation of California residency; (v) physical address and/or (vi) email. We may have a reason under the law why we do not have to comply with your request, or why we may comply with it in a more limited way than you anticipated. If we do, we will explain that to you in our response.

Right to Information Regarding Participation in Data Sharing for Financial Incentives 

We run promotions from time to time whereby we incentivize a consumer to share certain pieces of information with us. Participation in these incentives is voluntary, and you may opt out of the data sharing at any time.

Right to Opt out of Sale of Personal Information to Third Parties

You have the right to opt out of any sale of your personal information to third parties. To exercise this right, please visit the “Do Not Sell My Personal Information” webpage if you are using a Website or the Menu section of an App. Please note that your right to opt out does not apply to our sharing of personal information with service providers, who are parties we engage to perform a function on our behalf and are contractually obligated to use the personal information only for that function.

You have the right to receive non-discriminatory treatment based on your exercise of any of the privacy rights conferred by the CCPA.

We will rely on the following legal bases for processing your personal data, depending on our purpose for such processing.

You have consented to the processing of your personal data. We will obtain your consent before using or sharing your data for advertising that is targeted based on your browsing history, online behavior, or other personal data that we or third parties may have collected about you. Right to correction: You have the right to correct any inaccuracies in the personal data we hold about you and, where applicable, complete any incomplete personal data that we hold.

Right to erasure: You have the right to request that we erase the personal data that we hold about you, if one of the conditions in Article 17 of the GDPR applies.

Right to restriction of processing: You have the right to restrict our processing of your personal data, if one of the conditions in Article 18 of the GDPR applies.

Right to data portability: You have the right to receive personal data concerning you in a structured, common and machine-readable format or request transmission of the data to a third party, if the conditions in Article 20 of the GDPR are met.

Right to object: You have the right to object to processing of your personal data based on our legitimate interests at any time. We will no longer process the data, unless there are compelling legitimate grounds for our processing that override the interests, rights and freedoms of the data subject, or the processing serves the purpose of asserting, exercising or defending legal claims.

Right to withdraw consent: If we are processing your personal data based on your consent, you have the right to withdraw your consent at any time.

Lodging a Complaint

Under Article 77 of the GDPR, if you are located in the EU or the UK, you have the right to lodge a complaint with a supervisory authority if you believe that the processing of your personal data infringes your rights under the GDPR. The right to lodge a complaint may be invoked in the EU Member State in which you reside, in which you work or where the alleged infringement occurred.
